Questions

Healthcare staffing FAQ

If your question isn't here, call (703) 880-8412 and you'll reach a person.

Do you work with healthcare staffing agencies?

Yes. We advise staffing companies that place travel nurses, therapists, allied health and locum tenens clinicians on per diem and stipend programs, worker classification, multi-state payroll and IRS or state payroll audits.

Can our nurses or therapists be paid as 1099 contractors?

Only if they truly operate independently. When the agency sets schedules and rates, can remove the clinician and the work is its core business, the IRS and courts usually find employment, as the Tax Court did for a home health agency's nurses in Pediatric Impressions Home Health (2022). Virginia also presumes paid workers are employees.

Are travel nurse housing and meal stipends tax-free?

Only when the clinician is away from a genuine tax home on a temporary assignment and the agency pays under an accountable plan. Stipends that replace pay or go to local clinicians are taxable wages.

Do we need to register in every state where clinicians work?

Generally yes. Most states require withholding and unemployment insurance accounts when an employee works there, and placements usually create income tax nexus because staffing is a service.

Are staffing services subject to sales tax?

In some states. A few states tax temporary staffing or treat it based on the service performed, so taxability needs to be checked state by state.
