Basic eligibility
The business must be small under the size standard for its primary NAICS code and at least 51% unconditionally owned and controlled by one or more socially and economically disadvantaged individuals who are US citizens and of good character. The disadvantaged owner generally must manage day-to-day operations.
The firm usually needs two years in business in its primary industry, though SBA can waive this when other factors show potential for success.
Economic disadvantage
For economic disadvantage, the owner's adjusted personal net worth generally must be under $850,000, excluding the value of the 8(a) business and the primary residence. Additional tests limit average adjusted gross income over three years to $400,000 and total assets to $6 million, with certain exclusions such as retirement accounts.
Rules on demonstrating social disadvantage have changed since 2023 litigation, so applicants should expect to document their individual experience of disadvantage in detail.
Applying and staying in
Applications are submitted online through SBA's certification portal with tax returns, financial statements, personal financial statements, ownership documents and narratives. Clean, consistent financial statements make review smoother.
Once admitted, participants file annual reviews and must meet business mix targets in the later years of the program, so plan for non-8(a) revenue from the start.
